Any party can subpoena them. Filing a cross complaint against the spammer only costs $20. He never quite explained why he is suing SORBS rather than the spammer, especially since SORBS is protected by 47 USC 230 and the spammer isn't. Since the SORBS listing wouldn't have happened without the spammer, seems like a slam dunk to add him as a party. Other interesting Hawaii rules in small claims: "To sue a corporation, you must establish that it is registered in Hawai`i or doing business here." That will be a tough one to prove.
