I do. On Sep. 11 I noted, in a report to abuse@verizon.net: Dear Verizon, You might want to have a look at whichever of your customers is using the IP address 4.47.146.49. Whomever it is is beating the heck out of one of our mail servers, trying to deliver email into one of our domains using a wide variety of "From:" addresses. Here's a summary of yesterdays (Tues., Sep. 10, 2002) activity: [long list mercifully snipped] I just checked the mail log for today. Whomever it is, they're still at it. For that, I received an auto-ack with what presumably was a ticket number. The abuse continued. So on the 23rd, I wrote (as a reply to the previously issued ticket, btw): Dear Verizon, The network abuse from one or more of your customers continues unabated. Excerpts from last weeks logs are included following my signature. Whomever it is, they are obviously attempting a "dictionary" attack--trying a range of email names in hopes of some of them being valid. Even as I write this, just minutes ago whomever it is tried again from 4.47.147.185. From another network I ran an open proxy test (negative results), a "simple case" open mail relay test (negative results) and am currently port-scanning the offending host to see if there are any other obvious vulnerabilities. (No results available yet.) From what I've seen so far, it would appear that your customer or customers is/are the spammers. Please give this some attention and get it cleaned up. If Verizon fails to address this problem and the abuse from its network space does not abate, I will be left with no choice but to router-block 4.47.0.0/16 at all of our corporate routers. The next day the abuse continued. Herewith my last communication to Verizon abuse on the issue (again a reply to the previously issued ticket): Dear Verizon, The network abuse I've now reported to you twice already continues again today, with 85 new incidents. I'm *not* one of your customers. I'm the Senior Systems, Network & TelCom Admin for a corporation. I'm calling to report persistent abuse from your networks. Him: Well, you have to email... Me: I've already emailed your abuse@ address twice. The abuse continues. I need a phone number for your abuse people or network operations center. Him: I'm sorry, I don't have any such phone numbers. Me: (Patiently) Let me explain. This abuse has been going on for *three* *weeks*. Complaints emailed to your abuse@ address have been ineffective. If I can't get somebody over there on the phone *now*, I'm router-blocking the entire netblock containing the offending addresses at all of the network access points I administer. Him: There's nothing I can do, sorry. Me: Okay. Thanks anyway. Verizon is being blocked for not acting upon the complaints. Get rid of the spammer and the block will go away. In the meantime your other customers get to suffer for your actions, or in this cast the lack thereof. That is the way it works and it is working as intended. They did move it to level 2 since yesterday, which means not many people will be blocking it now. Looks like from the notation that this is an olive branch. They have given you what you need, now you need to respond by getting rid of the damn spammer. Philadelphia law firm Kohn, Swift & Graf, P.C. filed suit this week against Verizon on behalf of a DSL subscriber in a civil case that seeks class action status. Since 22 December, mail servers at verizon.net have been configured to reject connections from Europe and other parts of the world including China and New Zealand by default, according to Reg readers and industry sources such as MessageLabs. Verizon says the move is designed to reduce spam and says it is following industry best practice and applying blacklists as "narrowly" as possible. Domains can be unblocked on request but Verizon's catch-all filtering has generated fierce criticism, reflected in letters from Reg readers in response to our report last week on the e-blockade. John Vincenzo, a spokesman for Verizon, told us that the "vast majority" of Verizon's 4m dial-up and DSL customers are happy with its "long standing" policy on spam and virus filtering. He conceded that some otherwise legitimate email has been blocked but gave no indication that Verizon has any plans to review its policy. Vincenzo declined to comment on the class action lawsuit or explain how Verizon's filtering worked, beyond saying that the policy applied "globally". He forwarded us a prepared statement (republished below). According to Vincenzo, spam complaints come from spammers themselves. This sits at odds with our own correspondence from Verizon subscribers. Alan Gottlieb's email is typical in expressing frustration over Verizon's own subscribers (or former subscribers) over the email blockade. I read this article and it is unbelievable. I called Verizon to confirm this and they did. In consolation, they said I could build a list of domains to be permitted access. I have dozens of international contacts and am not about to go through this chore and I expect the reaction of many of their users will be the same... bail out!! As soon as I confirmed this, I called COMCAST. They will be installing tomorrow. I wonder how many people are going to get fired over this decision. Expat lawyer Alberto Costa reports similar problems I am a British lawyer resident in Boston. I have been affected by this nonsense Verizon policy. Even British government email accounts were blocked and my contacts there were unable to correspond with me. The Verizon netmail complaints department agreed with me and urged me to report the matter to the media. I wrote to the Verizon CEO, Ivan Seidenburg, all members of the Board of Directors and some Executive VP's. To date, I have not received a response from any. I will be closing my telephone, DSL and verizon netmail account at expense to me (changing business cards etc.) and moving to another provider. I am astounded at Verizon's arrogance and blatant breach of its own well published purported "codes of business conduct" which stipulate, inter alia, their respect and integrity towards their clients. At no stage was I informed of this email block and thus was not given the chance to communicate with members of the British government etc, by other means. Ed Lowitz has a practical suggestion I've lost e-mail as a result of this. To overcome it and possible future problems of its ilk, I've taken to enclosing my Yahoo e-mail address in my signature. ® STATEMENT FROM VERIZON ONLINE REGARDING SPAM FILTERING January 12, 2005 Spam is out of control. Leading providers of spam protection tools such as MX Logic, Inc. and MessageLabs report that some 80 to 90 percent of all e-mail today is spam. This is a major problem for Internet users in multiple ways. Spam clogs our mailboxes daily to the point where it threatens viability of e-mail as a communications tool. It also routinely carries viruses, identity-theft scams, spyware, zombie bots and other serious security threats. As an ISP, Verizon Online is working hard to address these serious security threats on the Internet by closely monitoring our network for incoming and outgoing spam and by working cooperatively with others across the ISP industry on anti-spam initiatives. These round-the-clock efforts include blocking spam and propagation of viruses from sources we identify using methods that are consistent with industry practices. This is a long-standing policy at Verizon Online. When we identify sources of spam or viruses, we block them as narrowly as we can and, where possible, we work directly with whoever manages that source to notify them of the issue. We then continuously monitor the source and will lift the block as soon as we are satisfied the threat has been resolved. In many cases, this is resolved within two days; however, we will not remove a block as long as a serious threat remains. The entire ISP industry is working to combat spam and other online security threats. Verizon Online is a member of various coalitions, including the Messaging Anti-Abuse Working Group that includes both large and small ISPs covering more than 100 million online subscribers. We also have aggressively pursued spammers through legal action, and taken a leading role in drafting legislation at the state and national level and working with domestic and international law enforcement agencies to combat spam other threats. In short, Verizon is committed to protecting its customers and its network from the serious security matters that threaten our use of the Internet everyday. Any spam blocking method will, inevitably, also result in the blocking or delay of otherwise legitimate email. This is yet another reason why spammers are harmful to the Internet community. If a Verizon Online customer believes they are not receiving legitimate e-mail, they should call our technical support desk for assistance and we will work with them to resolve their situation as quickly as possible. (It's probably not an accident that personnel involved with both are regular participants on Spam-L and have worked very hard to keep their own networks clean.) And third, this isn't Verizon's only controversial, and -- in my opinion -- silly -- "anti-spam" practice. Verizon is also doing something else which is: (a) ineffective (b) readily gamed (c) lends itself to DoS and DDoS attacks (d) provides a free, anonymizing spam support service And it really should stop, especially because of (c) and (d). What Verizon is doing is known as a "callback". This technique comes from people who have confused "spam" and "forgery" and are operating under the mistaken notion that doing something about the latter will have any substantial impact on the former. It works like this: When an incoming SMTP connection is made to one of Verizon's MX's, they allow it to proceed until the putative sender is specified, i.e., they wait for this part of the SMTP transaction: MAIL From: Then they pause the incoming connection. And then they start up an *outbound* SMTP connection from somewhere else on Verizon's network, back to one of the MX's for example.com. They then attempt to verify that "blah" is a valid, deliverable address there. But since most people have long since (sensibly) disabled SMTP VRFY, they actually construct a message and attempt delivery with RCPT. If delivery looks like it's going to succeed, they hang up this connection (which is rude), and un-pause the incoming one, and allow it to proceed. If delivery looks like it's going to fail, then they also hang up the connection (still rude), un-pause the incoming one, and reject the traffic. In other words, Verizon is faking mail -- thus generating yet more junk SMTP traffic at a time when we're drowning in junk SMTP traffic -- to do this. This also means that if the MX they try to connect to is (a) busy (b) down (c) unaware of all the deliverable addresses (d) something else, that they'll refuse the incoming message. Whoops. Real-world example: "support@thuleracks.com" is where mail from the support staff at Thule Racks comes from. However, it doesn't accept mail -- which is arguably a bad practice on Thule's part, but is not a good reason for Verizon to aggravate the problem by rejecting it. This technique (callbacks) is bad for a whole bunch of reasons: two of the more obvious ones are (1) it's a pathetic "anti-spam" measure because ANY forged address ANYWHERE will do, and (2) it doesn't scale -- it fails the "what if everyone did this?" test miserably. (Not clear? Consider what happens when site A, doing callbacks, sends mail to site B, doing callbacks. Now multiply by 1,000,000. Now toss in a few billion spam messages.) Add to that (3) it abuses RCPT because apparently Verizon is unwilling to use VRFY and to accept the decision of many/most mail server operators to disable it. Oh, and (4) the behavior of their probe systems is nearly indistinguishable from that of spam-spewing zombies, which don't obey the SMTP protocol either, and also rudely hang up connections in mid-transaction. But there's a not-so-obvious reason that this goes beyond merely a bad idea and into the realm of active support for spammers. A lot of people, including me, are blocking particularly problematic spammer-controlled networks at (a) our border routers (b) our firewalls or (c) our mail servers. In other words, we not only won't accept mail from them, we won't even allow them to connect: we're blocking *all* IP traffic from them. This prevents them from spamming; it also prevents them from building lists of deliverable addresses to sell to other spammers by poking at our mail servers. (See http://www.spamhaus.org/DROP/ for a list of network blocks that everyone should strongly consider blocking.) Now go back and look at what Verizon's doing. Since Verizon is doing this probing *from their network*, spammers can easily get around our blocking by getting Verizon to do the probing for them. For free. Anonymously. They can thus use Verizon to build/check their lists...and there's no way for us to find out who's on the other side of these probes. Which means that Verizon is running a free, anonymizing, spam support service. (And there are additional problems involving rate-limiting (or not), caching (or not), use of the callback mechanism to delay non-spam traffic, and callback-related exploits that can be used to game the mail servers of those running them -- again, see the Spam-L archives for full analysis.) Oh, Verizon's been told: one of their people was on the Spam-L list where this was discussed in considerable depth. But AFAIK, he doesn't work there any more; nobody else from Verizon has shown up; and attempts to contact a real live clueful human there via the designated RFC 2142 contacts ("postmaster", "abuse") have run into a brick wall. Verizon denies any liability to Plaintiffs and asserts various defenses to liability including its contractual right to block unsolicited email directed to its subscribers. B. After independent investigation and the exchange of formal and informal discovery, the parties engaged in comprehensive settlement negotiations. Following the parties' negotiations, and as a result of further investigations and expert consultation, the parties have reached an agreement (the "Settlement Agreement") providing for the settlement of the Actions. C. The Court has certified a class (the "Settlement Class"), for settlement purposes only, consisting of: "All business and residential customers of Verizon FiOS, DSL, and dial-up internet services in the United States at any time from October 1, 2004 to May 31, 2005 who had use of one or more email accounts on the Verizon.net email platform." The Class does not include subscribers of Verizon's managed messaging service, nor does it include any Verizon employees or their immediate family members. D. The Class Representatives and Class Counsel (listed below) believe that the claims asserted in the Actions have merit, but that the settlement, described below, is in the best interests of the Settlement Class. Class Counsel have evaluated information made available in the course of the Actions and have taken into account the risks and uncertainties of proceeding with this litigation. Those risks include the uncertainty of obtaining class certification, prevailing on the merits, proving substantial damages at trial, and prevailing on post-trial motions and likely appeals. Based upon their consideration of these factors, and on the substantial time and expense that will be incurred, the Class Representatives and Class Counsel believe it is in the best interests of the Settlement Class to settle the Actions on the terms described below. E. Verizon, while denying any liability to the Class Representatives or the Settlement Class, has agreed to settle the Actions for the purpose of avoiding the uncertainties and expense of, and diversion of business resources resulting from, further litigation. F. Neither the California Court nor the American Arbitration Association has determined the merits of Plaintiffs' claims or Verizon's defenses. This Notice does not imply that there have been or would be any findings of violation of the law by Verizon or that recovery could be had in any amount if the Actions were not settled. II. TERMS OF THE PROPOSED SETTLEMENT The following is a summary of pertinent provisions of the Settlement Agreement and is not a complete statement of the settlement or of the Actions. To take effect, this Settlement must be approved by the Court. A. Changes to Verizon's Spam-Blocking System Verizon has agreed to implement and has implemented certain changes to the manner in which it prevents spam from reaching Verizon.net email accounts, how it provides notice to senders whose emails are blocked, and how it responds to reports from customers and others that legitimate emails are being blocked. The changes are intended (1) to provide a better means of distinguishing between spam and legitimate email, so as more effectively to deliver legitimate email and limit the blocks to spam, (2) to make the new system more effective in providing automated electronic notification to senders when their email is blocked, and (3) to improve Verizon's ability to respond more effectively to reports that legitimate email has been blocked. B. Cash Awards 1. Settlement Class Members who did not receive legitimate email between October 2004 and May 2005 from a sender in the Asian region - which includes any of the countries listed at http://www.EmailBlockingSettlement.com/AsianRegion.htm - are eligible to receive a cash payment of $3.50 per month for each month from October 2004 to May 2005 during which they were a Verizon DSL, FiOS, or dial-up subscriber, for a maximum of eight months, or a maximum of $28.00. 2. Settlement Class Members who did not receive legitimate email between December 2004 and May 2005 from a sender in the European region - which includes any of the countries listed at http://www.EmailBlockingSettlement.com/EuropeanRegion.htm - are eligible to receive a cash payment of $3.50 per month for each month from December 2004 to May 2005 during which they were a Verizon DSL, FiOS, or dial-up subscriber, for a maximum of six months, or a maximum of $21.00. 3. To obtain this award, such Settlement Class Members must timely submit a properly completed Claim Form by August 9, 2006. Settlement Class Members who did not receive legitimate email between October 2004 and May 2005 from regions other than the Asian region and European region and who are not eligible to receive the relief described in paragraphs A(1) and A(2) above are entitled to receive, free of charge for a period of four consecutive months, the "Verizon Internet Security Suite" of services offered by Verizon to its subscribers at http://www2.verizon.net/micro/vissconsumer/. Verizon is not obligated to make the services available after the four-month period, but Verizon may choose to provide instructions to such Settlement Class Members on how to continue receiving the services for a fee. If Verizon provides such instructions, such Settlement Class Members may elect to continue to receive the services at the price and on the terms and conditions generally offered to the public. 2. To obtain these free services, such Settlement Class Members must timely submit a properly completed Claim Form by August 9, 2006. Settlement Class Members who cancelled their Verizon DSL, FiOS, or dial-up subscription at any time after September 2004 because of their inability to receive legitimate email, and were charged and paid an early termination fee, will receive from Verizon a full refund of the early termination fee paid. 2. Expanded Disclosure of Verizon's Spam-Blocking Policy The parties have agreed upon an announcement describing Verizon's current spam-blocking policies and steps subscribers can take to receive legitimate email while limiting the receipt of spam. The announcement may be found on the official class action website, http://www.EmailBlockingSettlement.com, or by visiting Verizon's website at http://netservices.verizon.net/portal/msa/bookmark?announcement&id=volspam . F. Additional Customer Support Verizon has agreed to provide additional guidelines and training for customer service and technical support on spam-blocking policies and procedures as well as services available to assist subscribers receive blocked email in accordance with Verizon's spam blocking policies. G. Release If the Settlement is approved by the Court, Settlement Class Members who have not filed a valid and timely request for exclusion shall be forever barred from suing Defendants and their past, present, and future directors, officers, employees, agents, insurers, shareholders, attorneys, advisors, consultants, representatives, partners, affiliates, parents, subsidiaries, joint venturers, independent contractors, divisions, predecessors, successors, and assigns, for any and all liabilities, claims, causes of action, damages, costs, attorneys' fees, losses, or demands, whether known or unknown, existing or potential, or suspected or unsuspected, that were or could have been asserted in the Actions. This release includes but is not limited to liabilities, claims, causes of action, damages, costs, attorneys' fees, losses, or demands, arising from Verizon's policies and procedures for the blocking or limitation of illegitimate, bulk, or abusive emails including spam and emails containing or believed to contain viruses, worms, or other threats. This release will bind all members of the Settlement Class regardless of whether they file a claim or receive any benefits under this settlement. In connection with the release and discharge of the foregoing claims, each member of the Settlement Class shall be deemed to have expressly waived all rights under California Civil Code section 1542 (or any like or similar statute or common law doctrine), and to have done so understanding the significance of that waiver. Section 1542 provides: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."
