Check out a piece of traci.net's Acceptable Usage Policy: "Electronic communication
Customers
are forbidden to send e-mail to any person who does not wish to receive
it (non opt-in). It is explicitly prohibited to send unsolicited bulk
mail messages ("junk mail" or "spam") of any kind (commercial
advertising, political tracts, announcements,...) or to post the same
or similar messages to large numbers of newsgroups (excessive
cross-posting or multiple-posting, also known as "USENET spam"). Customers
are forbidden to advertise their website in any third-party mailing
that is sent to any person who does not wish to receive it (non
opt-in). Customers hosting these "Spamvertised" websites must take
action with the third-party to ensure that their website URL or IP
address is not mentioned in their mailings, regardless of the
originating IP address. Unauthorized use, or forging, of mail header information (e.g. "spoofing"). Customers may not forward or propagate chain letters, nor malicious e-mail. These
rules apply to any Internet based distribution medium and any
application using the Internet as well (e.g. usenet news, fax-like
documents over the Internet). A customer may not solicit mail for
any other address other than that of the customer, except with full
consent of the owner of the referred address. Advertising,
transmitting, or otherwise making available any software, program,
product, or service that is designed to violate this AUP, which
includes, but is not limited to, the facilitation of the means to send
e-mail spam, initiation of pinging, flooding, mail-bombing, denial of
service attacks, and piracy of software. Sending email designed to
damage the target system when executed or opened; for example, sending
malicious programs or viruses attached to an email. Sending email which is designed to cause confusion, consternation, fear, uncertainty, or doubt, such as fake virus warnings. You must never subscribe anyone other than yourself to a mailing list. Maintaining an open mail (SMTP) relay.
Mailing List Subscriptions/Commercial/Opt-in E-mail:
TRACI
recognizes and encourages the role of the Internet as a valuable medium
for responsible advertising and marketing of commercial goods and
services. Internet Direct Marketing Companies which provide Mailing
List Subscriptions/Commercial/Opt-in E-mail services for third parties
must comply with the following guidelines
Double opt-in subscription process is strongly encouraged. Recipients
must be informed of how to correctly and easily remove themselves
(opt-out) from a mailing list in the event that they alter or change
email addresses, or wish to no longer receive mailings. Always remind people that they have opted in to your list. Customer must maintain a simple to use opt-out process. Opt-outs must be single opt-out, preferably a one-click http link embedded in the message. Customer must maintain a master opt-out list that is applied to all mailings. Customer must respond professionally and courteously to all complaints. Customer must respond to all complaints promptly. If you do not already have a procedure for handling complaints, you should create one. Customer
must maintain and be able to produce the following opt-in record
information on demand: opt-in date, first name, last name, subscriber
opt-in e-mail address, referrer site name or URL. When a complaint
is received, TRACI has the discretion to determine from all of the
available evidence whether the email recipients were from a legitimate
"opt-in" email list and take appropriate action in accordance with this
policy. An acceptable marketing database error rate not to exceed 0.000001 % of total subscribers. Additional
mailings sent after twenty four hours of a recipient opting-out may
result in a fine, temporary disconnection, or termination of service."
If
they enforce that, this one should be easy. He also owns
spaminsurance.com, which looks identical to antispamcard.com. This one
is also located at traci.net.
Anyone else find any more information? I'll write a letter to Traci.net tonight. |

| I have a complaint about one of your customers. I post in the forums at DSLReports.com. One of the forums is a Stopping Spam forum (»/forum/spam) where we discuss various tactics and programs which are useful for stopping spam. As articulated in the site rules, links of a commercial nature are prohibited.
"Examples NOT allowable: A link that is coded to trigger a click or referral payment to someone "Click here to sign up for great xyz service" (Company advert) "PC needs fixing? Click here for my website! Great rates!" (too commercial) "Join e-xyz.com book club today" (Referral trawling) "www.somethingservices.com" (where the site has a corporate/company face, and/or has employees or volunteers, other than the author)" »LINKS of a commercial nature
Your customer, the owner of antispamcard.com and spaminsurance.com (presumably his name is Brad Heckman), has been spamming our forum. An example can be found at »Best Spam fighter after SpamNet. Another example was deleted by the moderators. Research indicates that he is also sending unsolicited e-mails. He is listed on two websites as a spammer, and one is now blocking mail from his domain. That information is found at »www.rhyolite.com/anti-spam/spammers-a...[?] and »www.dolphinwave.org/spam/216.117.149.1..[?]
He has also falsified his registration information, and all information in it is listed as "n/a". »www.networksolutions.com/en_US/whois/r..[?]
All of this appears to be prohibited by your Acceptable Use Policy, particularly the passages labeled "Electronic Communication" and "Mailing List Subscriptions/Commercial/Opt-in E-mail". That he is running an "anti" spam outfit makes his spamming particularly objectionable. I and the other users at DSL Reports will gladly speak favorably of you as a spam fighting host if you would take action against this individual. Thank you for your time.

Yes, it is, but most are lax on the rule. »www.dolphinwave.org/spam/216.117.149.1..[?] shows that he also owns putamericatowork.com
Looks like he's taking advantage of the confidence of the patriotic.
"Brad
Heckman of West Palm Beach, Florida wants to help America stand tall in
a time of need. PutAmericaToWork.com was created to help American
people learn step-by-step on how to start their own business or how to
get a better job. I served our country during desert storm in the U. S.
Army and saw first hand how it affected the families of the troops sent
over seas. To see the same frustration on the faces of our great nation
again, was horrifying. That is why a part of the proceeds from any
purchase made on www.PutAmericaToWork.com will go toward the National
Military Family Association. Put America To Work can help America, pull
out of our current economic situation as well as generating a small
business boom, thus creating more jobs and economic diversity. As more
and more Americans are losing their jobs and taking pay cuts, they are
looking for way to replace lost income. Put America To Work can help
you get a new business off the ground. If starting your own business is
not for you. PutAmericaToWork.com has created step-by-step guidelines
to help you polish your resume and get it in front of the decision
makers. There is also a section for American companies to post American
jobs for the American people." »www.pressbox.co.uk/Detailed/6874.html[?] |

The owner of antispamcard.com recently spammed our Stopping Spam forum at DSLReports.com regarding a pay anti-spam service (which is against the site rules). While you are not hosting antispamcard.com, you are hosting another domain of his, putamericatowork.com. He is sending spam to others from there, more specifically, the IP 216.117.149.135 which is in one of your blocks. Evidence can be found at »www.dolphinwave.org/spam/216.117.149.1..[?]
This appears to be in violation of your Acceptable Use Policy, specifically, "Sending unsolicited email messages, including, without limitation, unwanted advertising and informational announcements, is explicitly prohibited, whether sent in bulk or not, and whether commercial in nature or not."
I and the other users at DSL Reports will speak favorably of you as a host if you take action against this individual. We believe his name is Brad Heckman. We have started a thread to collect information on him at »Antispamcard.com Information Collection

| NOTE: this is in response to the post by AmeritecTech I
got off work at 11 PM, but I stayed until 1:51 AM to finish compiling
this information and contacting hosts. I hope this serves as a lesson
to you, Brad. Spam is so utterly hated by some that they are willing to
sacrifice hours of their free time to get a spammer shut down. By
spamming the forum of some very talented and savvy spam warriors, you
set in motion a chain of events which you now have little or no control
over. No flavor of spam enrages me more than someone using spam to
promote an anti-spam service (not even porn spam). If my e-mails fall
on deaf ears at the hosts, I will phone them directly, and I won't give
up until I get a Page Cannot Be Displayed error on your domains.
As
evidenced by the other spam I've found from you, you've been jumping in
people's back yards for quite some time now. You just found the one
with the bulldog. [text was edited by author 2003-07-11 02:17:20]

I have a complaint about one of your customers. He registered antispamcard.com with you. I am a user at DSLReports.com. In our Stopping Spam forum, it is against the forum rules for a person to advertise their anti-spam service, as we consider this also to be spam. Someone recently spammed antispamcard.com at »Best Spam fighter after SpamNet
Upon looking up the registrant information, I found that all of the information was bogus, with no technical or administrative contact listed. The information from a networksolutions.org whois follows.

When I asked why the information was not complete, the poster said "Sorry for the delay, Registry fly has not registered our contact info with the who is data base, we are updating this now, Thank you" (»Best Spam fighter after SpamNet)
I am assuming he is lying and that he intentionally falsified the information.
We have also uncovered information that he is sending unsolicted e-mail to get traffic to his site. He is using spam to promote a supposed anti-spam site!

I was not aware of your service before tracking down this spammer, but you appear to have excellent prices for domain registration, and I would be happy to recommend your service to my friends and acquaintances if you take action against this individual. I am sure many of the other DSL Reports users would be just as appreciative. Thank you for your time.

morning, antispamcard.com and spaminsurance.com now have valid
registration information. Antispamcard.com is registered to Brad Hecker
and spaminsurance.com is now registered to Chad Deckard. Thusly, we
have discovered an ally for Hecker. It appears that Deckard is based in
West Palm Beach, Florida also. Lots of information on Deckard at »www.chaddeckard.com/whois.html[?] including some amusing pictures. The tempo thumps on.
