New customers will always start in the "bronze" mb00.net. After establishing a good track record with us, a bronze customer may be eligible to move up to "silver" ms00.net. Only customers that use closed-loop confirmations or double-opt-in will be eligible for "gold" mg00.net. Bronze: This is the default tier for all accounts. Silver: Movement into this tier will be based on specifics such as good standing -- in terms of complaints, source of recipients, documentation where required, and account status. Gold: This tier will meet all the requirements of Silver, and additionally must have confirmed, or double-opt-in method for gathering subscriptions. As you can see from the below, I've again spelled out my concerns to Earthlink as clearly as I possibly can. And guess what I got back yesterday from Earthlink tech support? Yet another stupid fucking email telling me how to do basic spam blocking on _my_ end. Like, "are you signed up for the Spaminator?" And so on. Isn't that why Earthlink uses Brightmail in the first place? I understand some spam will still slip through. They have a lot of tricks. But once notified, you should then be able to adjust _your_ filters so that it traps any subsequent spam from that sender. So why then do Earthlink and/or Brightmail continue to let "Sarcko's Special Deals" spam through? You've been repeatedly notified. It's been repeatedly submitted for inclusion in your "Spaminator" trap. It should be trivially easy to block, because it always has the same subject line, it doesn't munge the recipient's address in the "to" field, and the headers clearly show it comes through notorious spammers mb00.net/PMG/Mindshare. Yet it keeps coming through to the end user. Why? This is now an issue on news.admin.net-abuse.email. I'm told mb00.net/PMG/Mindshare offer several "levels" of spam accounts: bronze, gold and platinum. It's been suggested to me that Earthlink and/or Brightmail is receiving payola from mb00.net/PMG/Mindshare to let higher spam-account "levels" through to end users. Is that true? As a journalist, I'd sure be interested in a story like that. I've asked your support people the same question and requested a simple yes or no answer. They have ignored the question. The problem is that postmastergeneral spammed so hard and so long that just about every large site put all of their address space into local blocking lists. If you were just on something like SPEWS, that would be comparatively easy to get off of. All that needs to happen to get off of SPEWS is for the spam to stop. But getting out of the local blocks is nearly impossible because there are literally thousands of them. The folks who run them usually don't have any aging scheme, so nothing gets removed unless you talk to the guy that runs the list at that site, and with thousands of sites you can spend the rest of your life doing this. Verio won't shut postmastergeneral down, at least that's what the president's office told me when I talked with them two years ago. They just keep moving them around to evade the blocking lists. It is entirely Verio's fault that you have a problem; they are selling you a bad product. Demand to be moved to clean address space because what they are giving you is NOT what you are paying for. My ISP, txucom.net, would have stopped the spam permanently in less than 72 hours after it was first reported. So "some industry insiders consider" your AUP "to be among the strictest"? If it is, the enforcment of it is not even within light-years of "the strictest," as a comparison with txucom.net, iadwf.net, erols.com, airwire.net, io.com, npsis.com, & numerous other providers of various types will instantly reveal. So there are "significant misconceptions" about your company? Sorry, in the case of Funnymoney alone (& I haven't even started to discuss several of your other customers whom you have allowed to spam for similar lengths of time) I see no "misconceptions" whatsoever. On far too many occasions you have allowed your customers to spam for far too long a time. Every provider in the world, no matter what type of provider, be it Internet access, webhosting, etc., should stop its customers from spamming in less than 72 hours, & there are plenty of ISPs which have done this for years, even terminating large customers within this amount of time, & have never even once experienced the slightest legal difficulty over it. You allow even a single spamming customer to spam for more than 72 hours, & you are rogue, pure & simple, with a blatant disregard for the continued functionality of email worldwide. Why do you not insist that every last one of your customers uses exclusively confirmed opt-in mailing practices from the very first time they use your system in any way for marketing, & for the entire time they remain your customers? Legitimate business do not do this. When I called you guys to complain, you requested a list of our addresses. I refused to give it. If you need to clean your list, your list is bad. Spammers need to clean the list. Legitimate mailers will dump a list that they realize is bad rather than trying to clean it. When I shut off connections to our mail server, you guys started portscanning us and trying to find other places to deliver mail to. We started seeing barrages of attempts to open connections that I can only describe as a denial of service attack. This is the kind of thing that not even spammers do. This is the kind of thing hackers do. I normally don't block right off the bat. I filter and capture for awhile and try and work it out. When I started doing that with you I was truly amazed at the volume of messages you were sending at my users. Perhaps you had gotten some of them by legit means, but what brought you to my attention in the first place were the NDR's on addresses that had never been in existence in my domain. Half of the addresses you were hitting were invalid, either never existed or no longer existed. For laughs I tried unsubscribing some of the invalid addresses. That didn't stop it. Your server refused NDR's, so you were not cleaning your lists. Something I would think you do if you were truly concerned. With all the money you say you spent and you cant even get a decent script to accept NDR's and then listwash them? You won't honor 553's? So excuse me if I dont give a damn about how much effort and money you have spent to fix these problems. You should fire whomever worked on that project, because he wasted your money. You want to refute claims that you are a spammer? Then refute some of the specific items that people have mentioned in their posts.
