(I looked. It's spam.) Topica continues to try to send to my real and spamtrap addresses, at all of the mail servers I admin, *despite* the fact those servers have been 5xx'ing Topica's attempts since anywhere from on-or-about April 19 or on-or-about May 29th, based on SPEWS or blackholes.2mbit.com listings. Here's something I wouldn't have noticed but for Topica's insistence on claiming their innocence despite what would appear to be overwhelming evidence to the contrary. In searching through my daily and weekly mail log analysis data for the paragraph above, I couldn't help but notice that my servers seem to spend an inordinate amount of time accepting email from (well, used to) their servers and trying send *something* to them. I'm not going to go to the trouble of finding out what was being sent to them, I'll just take a guess. When a mailandnews account is full it returns a temporary error 451 Recipient mailbox is full After three days and no change in status, a permanent error is sent 551 Recipient mailbox is full Days, months, even years after receiving a permanent error, Topica and Yahoo will continue sending email to mailboxes that are reporting full. In some cases a single account might receive a thousand messages per day. For every message sent, our servers send an error message back to Yahoo and Topica and it is ignored. This creates a tremendous and unnecessary load on our servers and is also a major drain on our bandwidth. This is a violation of the RFC's for handling email and error messages. These two companies are responsible for over 80% of all error messages our servers send out and over 20% of all email traffic coming into the system. Topica and Yahoo are the only ones that are doing this. Most other email list companies correctly handle full mail box messages. Yahoo has not responded to any of our email asking for help resolving this problem. So we implemented the blocks on Wedensday, May 8, 2002. Topica has been blocked since April 24, 2002. We tried to work with Topica for weeks before implementing the block. Despite numerous emails from Topica promising to fix the problem, Topica has not done anything. The fix is simple. If an email account is full, after a certain period of time, the email list company needs to remove the address from the list and quit attempting to send invalid email. Instead I "unsubscribe" spamtrap addresses that automatically result in getting added to widely-used blocking lists if they are spammed again. Yup. I just got one of their "thank you for joining topica" crap on an email address that I only used to communicate with a buyer who bought some motorcycle parts from me locally. I've never done business with that email address for anyone. So i fired off a lart to them and removed anything before the @ symbol in my address and told them to shove it. They will continue to get complaints until they REMOVE all email addresses that ended in my ISP's domain name since I never signed up with them. They want to listwash, well, they have to work to find out what address to listwash. There are now just over 300,000 users with @ hawaii . rr . com ; let them figure out which one of out of the 300,000 that maybe in their system to listwash. I aint doing their work. So, today I have copied over several of my procmail recipes from my primary shell provider to my connectivity provider's machine, and am now running them (and will be updating them) in tandem. Of course, I've procmailed out Topica's IP space, so I won't see any more crap from that hole. If you would like further clarification, or have questions or comments, please write to me directly. Please note that I am giving as much information as I can, but there may be names and such which I cannot share. However, based on what Mr. Betz already shared, I can offer enough to give you a good sense of the situation. Last weekend we received complaints from a few different individuals, including Mr. Betz, forwarding email which was from one of several of Topica's "Topica Exchange" mailing lists. This was notable because to date the only complaints we have had regarding any of the Habeas-warranted Topica mailing lists were complaints of "content which was not on topic, and therefore I consider it spam", and a couple of complaints where people said that they had not signed up, but in fact Topica was able to produce the confirmation information. The first several complaints we received were through a spam reporting service which removes the complainant's identifying information, so it's useful to note that we really couldn't do much investigation until we got matching complaints through our own reporting system, with the recipient's information intact. (It's one thing if a list isn't confirmed opt-in, etc., because then it is clear that the problem is with the list itself, but in a case where a list is or is supposed to be confirmed, without knowing who is claiming that they weren't really confirmed, there is no useful way to investigate, or for us to demand proof of confirmation.) Hence we couldn't really drill down into what was going on when we got the first complaints - so there was small lag. Once we started seeing who the complainants were, we immediately noted that without exception, each person complaining was someone from the anti-spam community, or whose email address otherwise appeared in NANAS within the past several months. We then noted the lists complained of, and tried signing up for them ourselves on the Topica website. They required confirmation, as they are supposed to. We took this information to Topica, and together we pored over all list subscriptions for each of the targetted individuals. (I believe that Mr. Betz may have received such a list for his "subscriptions"). We quickly noted that for each targetted individual, there was a mass attempt to subscribe to many many lists, all occuring on the same date, at roughly the same time. The connecting IP address most often used turned out to be one belonging to safeproxy.org We noted that some of the lists actually did allow the subscription without the confirmation going out, and others had not, and were holding the subscription as "pending", as it should do. Puzzling over the fact that we knew that these particular lists were confirmed opt-in, and we'd tested them ourselves, and noting that the timestamp on these numerous subscriptions and subscription attempts were very very close, we realized that it would have been nearly impossible to enter so many subscription requests through a web interface, and we suddenly realized that someone must have mass *mail* subscribed the addresses. We quickly tested this, and sure enough, while the confirmation process worked as it was supposed to when someone signed up through the website, if one instead sent a subscription request to the subscription request email address, some of the lists did not operate as intended (by sending out a confirmation request) but instead simply subscribed the address to the list. Topica *immediately* fixed the bug on all compromised lists, and then searched their whole confirmed opt-in mailing list base for any other lists having this bug. They closed those too (yes, we tested them). So, to the question of the day: Did spam come from Topica's confirmed opt- in list block, bearing our headers? Yes. Was it intentional on the part of Topica, or even a known issue? No. Did Topica fix it immediately as soon as they found out about it? Yes. They were _extremely_ cooperative. I think that Mr. Betz will bear me out there. They did not give us the runaround, they did not brush us off, and they did not try to listwash. They fixed the problem. So, the answer is no, we aren't going to sue them. This is no different than if any of you were Habeas licensees (and many of you are), and your server was hacked into and used for a spam run. Would we immediately pull your license and sue you? Not if you fixed the problem as soon as we brought it to your attention. And most especially not if it was an isolated incident. One of our goals is to push the adoption of confirmed opt-in. Another is to ensure that those who say they use confirmed opt-in actually do. In this instance, there was a problem with a confirmation system, and we demanded that it be fixed, and it was. To sue someone under these circumstances would make no sense, and would have no impact on the greater plan, which includes encouraging non-confirmed houses to move to confirmed opt-in. All it would do would be to tell them "even if we do move to confirmed opt-in, if there is a glitch, or we are subject to an attack, we'll get sued." Make no mistake - even if a problem is unintended, or the result of a 3rd party attack - if it is not taken seriously, and not fixed in a timely manner, we *will* take action, including revoking a license, and suing. We watch all of our licensees very closely. But we're not going to apply a different standard to Topica just because they are Topica. Anne P. Mitchell, Esq. They hit me more than once a day for the last month, and all of them get 550 (RBL relays.osirusoft.com) returned. I asked them to explain why this was not good enought to stop mailing me. The first responce I got was an auto ack to tell me how to unsubscribe. I responded that was not the question. The second and third were auto ignore messages telling me that I was unsubscribed. So, I mail cogent... asking them to look in to why topica cannot accept 550 as an answer. I actually get a responce... telling me to give them the domain name so they can "investigate" (list wash) I told them I would not let them listwash me, and that I wanted to know why 550 isnt good enough... Please let us know if we can get this range opened up. I responded through spamcop's anonymous reply feature that I would not reveal the address because it was a spamtrap. They then wrote back saying that xxx@spamcop.net had been removed from their list. The only way they could have figured it out is from stuff they coded into the headers, that spamcop didn't remove. -A
